Terms of Service for Handymen & Service Providers

These Terms of Service for Handymen and Service Providers (“Provider Terms”) govern your use of HandymanCoop.io as a service provider, handyman, contractor, or business listing services on or through the platform.
1. Independent Contractor Status
You acknowledge and agree that you are an independent contractor or independent business and not an employee, agent, franchisee, partner, joint venturer, or representative of Handyman Coop. You are solely responsible for the means and manner of performing your services, including scheduling, labor, supervision, tools, equipment, methods, and transportation.
2. No Employment Relationship
Nothing in these Provider Terms creates any employment, agency, partnership, or fiduciary relationship between you and Handyman Coop. Handyman Coop does not withhold taxes, provide wages, benefits, workers’ compensation, unemployment insurance, tools, equipment, vehicles, or training as an employer would.
3. Taxes, Licensing, and Insurance
You are solely responsible for your taxes, registration, licensing, permits, insurance, workers’ compensation obligations, subcontractors, assistants, and legal compliance. You represent that you will comply with all laws, regulations, codes, and permitting requirements applicable to your services and your business.
4. Service Responsibility
You are solely responsible for the services you offer and perform, including workmanship, scope accuracy, safety, compliance, customer communications, arrival times, clean-up, tools, materials, pricing disclosures, and claims arising from your work. Handyman Coop does not supervise or control your work.
5. Platform Role
Handyman Coop provides a marketplace, lead routing, listing, matching, and referral platform. We may display your profile, send you requests, or refer opportunities, but we do not guarantee any minimum volume of leads, revenue, assignments, or bookings.
6. Profile Accuracy
You agree to provide accurate, current, and complete information in your profile and communications, including your identity, experience, service area, availability, service categories, qualifications, and credentials. You may not misrepresent your background, insurance, pricing, or ability to complete work.
7. Conduct Standards
You agree to act professionally, lawfully, and respectfully. Prohibited conduct includes fraud, misleading statements, harassment, illegal work, unsafe conduct, discrimination, hidden fees, bait-and-switch pricing, off-platform abuse, and any conduct that may expose Handyman Coop or users to risk.
8. Fees and Payments
Handyman Coop may charge listing fees, lead fees, subscription fees, referral fees, commission-based fees, promotional fees, or other marketplace fees as disclosed on the platform or in a separate written schedule. We may modify pricing, fee models, and participation requirements at any time.
9. Consumer Disputes
You are solely responsible for disputes related to your services, including workmanship complaints, cancellations, damages, refunds, missed appointments, code issues, property claims, or customer dissatisfaction, except to the extent Handyman Coop expressly agrees otherwise in writing.
10. Insurance and Risk Allocation
You are solely responsible for maintaining insurance you deem appropriate for your services and risk profile, including general liability insurance and any legally required coverage. Handyman Coop does not insure your work unless expressly stated in writing.
11. Suspension and Removal
Handyman Coop may suspend, restrict, demote, hide, or terminate your account, listing, visibility, or access at any time and for any reason, including quality concerns, complaints, suspected misconduct, inaccurate information, policy violations, legal risk, or business reasons.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” HANDYMAN COOP MAKES NO GUARANTEES REGARDING TRAFFIC, LEADS, BOOKINGS, CONVERSION, PROFILE VISIBILITY, SEARCH POSITION, OR REVENUE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDYMAN COOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR ANY CUSTOMER INTERACTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HANDYMAN COOP FOR ANY CLAIM RELATING TO THE PLATFORM OR THESE PROVIDER TERMS SHALL NOT EXCEED ONE THOUSAND DOLLARS (US $1,000) OR THE AMOUNT OF FEES PAID BY YOU TO HANDYMAN COOP IN CONNECTION WITH THE APPLICABLE SERVICE OR TRANSACTION, WHICHEVER IS LOWER.
14. Indemnification
You agree to defend, indemnify, and hold harmless Handyman Coop and its affiliates, owners, officers, employees, contractors, and agents from and against all claims, liabilities, damages, losses, judgments, costs, and expenses, including attorneys’ fees, arising out of or related to your services, your conduct, your listing, your workers, your assistants, your taxes, your insurance, your violation of law, or your violation of these Provider Terms.
15. Governing Law
These Provider Terms shall be governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules.
