Terms of Service for Consumers

These Terms of Service for Consumers (“Consumer Terms”) govern your access to and use of HandymanCoop.io and related services. By using the platform, you agree to these Consumer Terms.
1. Platform Role
Handyman Coop is an online marketplace and referral platform that helps connect consumers with independent service providers. Handyman Coop does not itself perform home services unless expressly identified in writing for a particular transaction. In most cases, services are offered and performed by independent third parties, not by Handyman Coop.
2. Independent Service Providers
Service providers available through the platform are independent contractors or independent businesses, not employees, agents, joint venturers, or representatives of Handyman Coop. Handyman Coop does not control the manner, means, methods, scheduling, supervision, tools, or execution of the services performed by service providers.
3. No Guarantee of Service Provider Performance
Handyman Coop does not guarantee the quality, legality, safety, suitability, timeliness, licensing status, insurance status, credentials, conduct, or results of any service provider or any service performed by a service provider. Any descriptions, categories, reviews, badges, or profiles are for informational purposes only and do not create a warranty or guarantee.
4. Your Responsibilities
You are responsible for evaluating and selecting your service provider and for confirming that any provider is appropriate for your project. You are also responsible for verifying pricing, project scope, insurance, licensing, permits, access conditions, measurements, safety requirements, and any building or landlord rules that apply to your property.
5. Quotes, Requests, and Direct Booking
The platform may offer more than one path, including posting a request for matching or booking directly with a fulfillment partner. Handyman Coop may route or refer requests to independent providers or affiliated fulfillment providers. Submission of a request does not guarantee provider availability, acceptance, or completion of service.
6. Payments
Payments may be processed through third-party systems or may be made directly to the provider depending on the transaction flow. Handyman Coop is not responsible for off-platform payment arrangements, cash transactions, chargebacks, financing terms, or disputes arising from payment arrangements between users and providers, except as expressly required by law.
7. Cancellations, Delays, and Rescheduling
Availability, response times, cancellations, rescheduling, or delays are not guaranteed. Specific cancellation, refund, or rescheduling terms may depend on the provider, fulfillment partner, or booking flow used for the transaction.
8. User Conduct
You agree not to misuse the platform, submit false information, harass providers, interfere with platform operations, attempt unauthorized access, scrape data, or use the platform for unlawful, fraudulent, or abusive purposes.
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, OR ACCURACY.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDYMAN COOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, REVENUE, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE PLATFORM OR ANY SERVICE PERFORMED BY AN INDEPENDENT SERVICE PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HANDYMAN COOP FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM, ANY MATCH, ANY REFERRAL, OR ANY TRANSACTION SHALL NOT EXCEED ONE THOUSAND DOLLARS (US $1,000) OR THE AMOUNT PAID FOR THE APPLICABLE SERVICE, WHICHEVER IS LOWER.
11. Indemnification
You agree to defend, indemnify, and hold harmless Handyman Coop and its affiliates, owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the platform, your project, your property conditions, your interactions with providers, your violation of these Consumer Terms, or your violation of law.
12. Disputes Between Users and Providers
Any dispute regarding workmanship, delays, property damage, pricing, scope, refunds, cancellations, or project outcomes is primarily between the consumer and the independent service provider unless Handyman Coop expressly agrees otherwise in writing.
13. Suspension or Termination
We may suspend or terminate access to the platform at any time, with or without notice, if we believe a user has violated these Consumer Terms, created risk, or misused the platform.
14. Governing Law
These Consumer Terms shall be governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules.
15. Changes to These Terms
We may update these Consumer Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
